Substantial modification
A modification that legally turns the operator into a manufacturer – with risk assessment, conformity assessment, operating instructions and CE marking for the modified equipment. Typical triggers are an increased capacity, a changed function or a new hazard that cannot be controlled by simple protective measures. Where the threshold lies in a given case is a matter of judgement – and the question is usually asked too late, namely after the work.
